Terms and Conditions of Sale

1) Seller Identity

2) Subject and Scope
These terms and conditions govern the online sale of products offered on this Shopify site to consumers (B2C) and, where applicable, also to professionals (B2B). Placing an order implies full acceptance of these terms and conditions, the Privacy Policy, and the Cookie Policy.
3) Eligibility, Account, and Accuracy of Data
To purchase, you must be at least 18 years old and legally competent. It is the customer's responsibility to ensure that the information provided (personal details, address, contact information, and VAT number, if applicable) is true, accurate, and up-to-date. Account access is personal; the customer is responsible for any unauthorized use of their credentials.
4) Product and Color Information
Features, sizes, and materials are described on the relevant product pages. Images are for illustrative purposes only: colors and yields may vary based on display, lighting, and production batches. Measurements may have physiological tolerances.
5) Prices, Taxes, and Obvious Errors
Prices are in euros and, unless otherwise indicated, include VAT. Shipping costs, surcharges (e.g., cash on delivery), and duties (for international shipments, if activated) are shown at checkout. In the event of an obvious pricing or description error, we reserve the right to cancel the order and issue a full refund.
6) Discount Codes, Promotions, and Gift Cards
Coupons and promotions cannot be combined unless otherwise indicated and may be subject to expiration or limited quantities. Gift Cards (if available) are digital bearer cards, non-refundable, and non-exchangeable for cash.
7) Availability, Pre-orders, and Customizations
Availability is indicative. If items are unavailable after you place your order, you will be notified and refunded. Pre-orders have estimated delivery dates and are subject to change. Customized products are made specifically for you and follow specific rules regarding returns/exchanges (see §16).
8) Order Process and Contract Conclusion
Add products to your cart, review the summary and costs.
Enter your shipping/billing information and payment method.
Confirm your order: you will receive a confirmation email.
The contract is considered concluded upon our acceptance (order confirmation or fulfillment).
9) Payments and Security
We accept major cards (Visa/Mastercard/AmEx), PayPal, Apple Pay/Google Pay (if enabled), and cash on delivery (€5.00). Cash on delivery requires payment in cash upon delivery (exact amount). Payments are processed in a TLS/SSL environment and tokenized by the providers; we do not store complete card details.
10) Anti-Fraud Checks
For security purposes, we may perform additional checks or request additional information. In the event of suspected fraud or misuse, we may cancel the order and issue a refund.
11) Invoicing
For electronic invoicing/VAT, please provide the correct information during checkout. Post-order requests may not be accepted.
12) Shipping, Times, and Costs (Italy)
Preparation: Handover to the courier within 24–48 business hours.
Average delivery: 48–72 hours from pickup (excluding holidays, remote areas, or seasonal peaks).
Costs in Italy: €5.00 for standard shipping; cash on delivery + €5.00.
Free for orders over €100.00 (standard shipping only in Italy).
International shipping may not be available at this time; when available, rates and delivery times will be indicated by country.
13) Tracking, Delivery, and Risk
We send an email with tracking information upon shipment. Risk of loss/damage passes to the customer upon delivery. Please check the integrity of packages and immediately report any anomalies to the courier and customer support.
14) Incorrect Address, Undelivered Items, Failed Attempts
In the event of an incorrect/incomplete address, undelivered items, or returns, any additional costs charged by the courier are the customer's responsibility. After successful delivery attempts, the package can be returned to the sender; return and reshipping costs are the customer's responsibility.
15) Right of Withdrawal (consumers only)
You have 14 days from delivery to withdraw from the contract without having to provide a reason (Legislative Decree 206/2005).
To exercise your right of withdrawal:
Fill out the Return Form (or send an explicit declaration via email) and include it in the package.
Repackage the products intact, with labels/seals and original packaging.
Send the goods by courier at your expense within 14 days of notifying us of your withdrawal to:

16) Returns Exclusions
Returns do not apply to:
Personalized or clearly made-to-measure products;
Sealed goods that are not suitable for return due to hygiene reasons and have been opened (e.g., underwear/swimwear without hygienic protection);
Goods that are used, washed, damaged, or missing labels/seals or original packaging.
17) Returns, Quality Control, and Refunds
Upon receipt, we perform a Quality Control check within 2–3 business days. If compliant, a refund will be made to the original payment method; credit may take an additional 3–5 business days depending on the bank/cardholder.
Original shipping costs are non-refundable, except for returns of defective/incorrect products. For defective/incorrect items, please contact us first: we will provide instructions and any return label, at our expense.
18) Size Exchanges
Contact us before shipping your return: we can reserve the desired size and provide instructions. Return shipping is the customer's responsibility; new shipping follows this Shipping Policy.
19) Legal Guarantee of Conformity
Consumers are covered by a 24-month warranty (Articles 128–135-septies of the Consumer Code). The defect must be reported within 2 months of discovery, with proof of purchase and documentation (photos/videos).
Remedies: repair or replacement; if impossible or excessively costly, price reduction or termination with refund. For professional/B2B customers, the guarantees provided by the Civil Code apply.
20) Liability and Indemnity
Except in the case of willful misconduct or gross negligence, MDR Studios is not liable for indirect damages, lost profits, lost opportunities, or damages resulting from improper use of the products. It is the customer's responsibility to verify the suitability, care, and maintenance of the items according to labels and instructions.
21) Force Majeure
We are not responsible for delays/non-performance due to force majeure (strikes, natural events, service interruptions, pandemics, wars, government measures, etc.). In such cases, the terms are suspended for the duration of the event.
22) Intellectual Property
Trademarks, logos, text, photographs, and the website layout are protected. Any reproduction, modification, or unauthorized use of the content is prohibited.
23) Reviews and User Content
Reviews must be truthful and relevant to the product, free of offensive language, advertising, or misleading information. We reserve the right to moderate or remove inappropriate content.
24) Privacy and Cookies
Personal data is processed in accordance with our Privacy Policy; cookies are used in accordance with our Cookie Policy and consent banner. We invite you to review the updated content.
25) Applicable Law, Conciliation, and Jurisdiction
The contract is governed by Italian law. For consumers, the court of their place of residence or domicile has exclusive jurisdiction. For professional/B2B customers, the Court of Naples has exclusive jurisdiction.

26) Changes to the Terms and Conditions
We may periodically update these terms and conditions (due to regulatory changes or service improvements). The text published at the time of ordering applies.
